WHAT IS IT ABOUT?

 

Released in February 2013, the Market Surveillance Package is an EC package proposal to improve consumer product safety and strengthen market surveillance of products in the EU.

 

It is composed of the two following proposals:

  • A regulation proposal on Market Surveillance of products
  • A regulation proposal on Consumer Product Safety

The European Institutions have to agree on the package before April 2014.

 

WHAT ARE THE POSSIBLE CONSEQUENCES FOR CONSTRUCTION PRODUCTS?

 

The Consumer Product Safety Regulation (CPSR) proposal includes construction products in its scope, which means that construction products would be covered by both the CPR and the CPSR.

 

It would imply that: 

  • Instructions and safety information should be provided according to both the rules of the CPR and the CPSR.
  • Construction products would be covered by other initiatives proposed in the framework of the CPSR including EU safety tested mark (previously called CE+).
  • Construction products would have to bear a label mentioning their country of origin.
WHAT IS CPE’S POSITION?

 

Our members agreed on the following positions: 

  • CPE thinks that instructions and safety information should be provided only according to the CPR.
  • CPE rejects the need for EU safety tested mark for construction products because the CPR already covers the surveillance of products according to different AVCP systems and some of them require third party verification.

The members could not agree to any common position on the issue of country of origin.

 

WHAT ACTIONS ARE WE GOING TO TAKE?

 

Given the mixed feelings about the impact of the regulation, Construction Products Europe agreed with its members not to carry out any lobbying activities regarding this package for now.

 

LATEST NEWS

 

On 17th October 2013, the IMCO Committee of the European Parliament voted for an exclusion of the products covered by the CPR from the scope of the CPSR.

 

The EP may proceed to formal 1st readings of the proposed CPSR and MSR in April as no progress in trialogue.
